1. A Will is a declaration by which a person (“testator”) names person(s) to manage his estate which he desires to be carried on after his death.
  2. The term Will is defined under Section 2(h) of the Indian Succession Act, 1925 as “Will means the legal declaration of the intention of the testator with respect to his property which he desires to be carried into effect after his death.”
  3. Every person of sound mind not being a minor may dispose of his property by Will”.

  13. Drafting of Will: It is not necessary that a Will should be drafted in technical words, the wordings so used in the Will should be able to reflect the intentions of the testator. The meaning of any clause in a Will is to be collected from the entire instrument and all its parts are to be construed with reference to each other.
